Workers’ comp insurers and employers often won’t aggressively fight relatively minor claims. There’s a huge difference between a claim that only costs $1,000 and results in an employee missing work for a week and an injury that costs $50,000 to treat and results in an employee being out of work for six months.


The worker who is looking at six months of no wages is in a significantly more difficult financial situation than the worker who is only going to miss a week of work. The insurer and the employer also have a lot more to lose, which means they have more incentive to dispute the injured worker’s claim.

What to Do After Suffering a Catastrophic Injury at Work

The priority of any injured worker or their family members is to receive fast, thorough medical care. All injured workers need to visit one of the doctors or medical facilities listed on their employer’s panel of physicians for case management, but those doctors generally don’t provide emergency assistance. If you’ve suffered a catastrophic injury at work, don’t hesitate to visit an ER or call 911.


Once your condition is stabilized you should file the necessary paperwork with your employer and the Georgia State Board of Workers’ Compensation. Then you’ll need to visit one of the doctors on your employer’s panel of physicians.


Follow all prescribed treatments. You and your legal team can dispute the conclusions of these doctors if you believe they are wrong, but you shouldn’t ignore prescribed medications, physical therapy or treatment plans. If your refusal to comply results in delayed recovery, some or all of your claim could potentially be compromised.
